The terms that govern your access to and use of this website. Please read them carefully before you use it.
Last updated: 19 October 2026
In short
The website gives general information only. It is not legal advice.
An advocate and client relationship arises only from a written engagement.
Please do not send confidential information before an engagement.
1. Introduction and Acceptance of Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the website of Advocult India, and of every page, form, document and feature available on it. Please read them carefully before you use the Website.
1.1 The Website is owned and operated by Advocult India, a law firm whose contact details are given in section 17 (“Advocult”, “the Firm”, “we”, “us” and “our”).
1.2 By accessing or browsing the Website, by clicking to accept where the Website invites you to do so, or by using any of its features, you agree to be bound by these Terms and by the Privacy Policy. If you do not agree with any part of them, please do not use the Website.
1.3 The Website is meant for persons who are at least eighteen years old and competent to contract under the Indian Contract Act, 1872. If you are below that age, please do not use the Website.
1.4 These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, as amended from time to time. They are generated by a computer system and do not require any physical or digital signature.
1.5 To the extent the Website is an intermediary within the meaning of the Information Technology Act, 2000, these Terms and the Privacy Policy are also published in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
1.6 If you use the Website on behalf of an organisation, you confirm that you are authorised to bind it to these Terms.
1.7 If you have a written engagement with the Firm, its terms govern the matters it covers. Where they differ from these Terms, the terms of the engagement prevail as regards those matters.
2. Definitions and Interpretation
2.1 In these Terms, unless the context requires otherwise:
(a) “Applicable Law” means all laws, rules, regulations, orders and directions in force in India from time to time, including the Advocates Act, 1961, the Bar Council of India Rules, the Information Technology Act, 2000 and the rules made under it, the Digital Personal Data Protection Act, 2023 and the rules made under it, the Copyright Act, 1957 and the Trade Marks Act, 1999;
(b) “BCI Rules” means the Bar Council of India Rules made under the Advocates Act, 1961, including the rules on professional conduct and etiquette;
(c) “Content” means all text, articles, summaries, publications, graphics, logos, names, designs, images, audio, video, software, data, layout and other material on the Website;
(d) “Intellectual Property Rights” means copyright, trade mark, design, database, goodwill and passing off rights, rights in confidential information and all similar rights, whether registered or not, anywhere in the world;
(e) “Privacy Policy” means the Privacy Policy published on the Website, as updated from time to time;
(f) “Submission” means any information, message, enquiry, document, résumé or other material that you send to us through the Website or through the contact details given on it;
(g) “User” or “you” means any person who accesses or uses the Website; and
(h) “Website” means this website, its sub-pages, forms and features, and any other online channel run by us that links to these Terms.
2.2 Headings are for convenience only and do not affect the meaning of these Terms.
2.3 The words “include” and “including” are not words of limitation.
2.4 A reference to a statute or rule includes that statute or rule as amended, re-enacted or replaced from time to time, and any rule, order or notification made under it.
2.5 Words in the singular include the plural, and the other way round.
3. Nature and Purpose of the Website
3.1 The Website provides general information about the Firm, its areas of practice and the manner in which it may be contacted. It is published for the information of the reader and for no other purpose.
3.2 The Website is not an advertisement and is not intended to solicit work or to influence any person to engage the Firm, whether directly or indirectly. The Firm is bound by Rule 36 in Chapter II of Part VI of the Bar Council of India Rules, which prohibits advertisement and solicitation by advocates, and it has prepared the Website with regard to that rule and the proviso to it which permits certain information to be made available on a website.
3.3 The Website is not intended to display rankings, client names or the results of cases, and nothing on it is a promise or assurance that any matter will have a particular outcome.
3.4 Any description on the Website of the Firm’s areas of practice, or of the sectors and branches of law in which it advises, is a general statement of the scope of its work. It is not a claim of specialisation in any branch of law.
3.5 You visit the Website, and read its Content, of your own accord.
4. No Legal Advice and No Advocate and Client Relationship
4.1 The Content is for general information only. It is not legal advice or a legal opinion, and it must not be relied on in place of advice from a qualified advocate on your own facts. The law changes, and the Content may be out of date or incomplete when you read it.
4.2 Visiting or using the Website, reading its Content, sending a Submission, filling in a form, writing to, telephoning or meeting any person connected with the Firm in response to the Website, or receiving an acknowledgement or reply from us, does not create an advocate and client relationship between you and the Firm or any of its partners, advocates or staff.
4.3 That relationship arises only when the Firm has agreed in writing to act for you, after it has checked for conflicts of interest and has accepted the matter. Until then, the Firm owes you no duty to advise, to act, to meet any deadline or to keep a matter open.
4.4 Please do not send us confidential, privileged or time sensitive information through the Website before an engagement is in place. Communications made before an engagement may not be protected by legal privilege. Sending a Submission does not stop any period of limitation or any deadline from running, and if your matter is urgent you should take legal advice without delay.
4.5 Acknowledgement under the Bar Council of India Rules. By clicking the button to accept, or by continuing to use the Website, you acknowledge and confirm that:
(a) the Bar Council of India does not permit advocates to advertise or solicit work in any form or manner;
(b) you are seeking information about the Firm of your own accord, and there has been no solicitation, advertisement, personal communication or inducement of any kind by the Firm or by any of its partners, advocates or staff;
(c) the information on the Website is provided only to give you an understanding of the Firm and its areas of practice, and you will not treat it as legal advice, advertisement or solicitation;
(d) the Firm has taken care to ensure that the information on the Website is true and accurate, but makes no representation that it is complete or current; and
(e) neither the Firm nor any person associated with it is liable for any action that you take, or refrain from taking, in reliance on the information on the Website.
4.6 The Firm is an Indian law firm. Nothing on the Website is advice on the law of any other country, and the Website is not directed at any person in a place where its publication would be contrary to the law of that place.
5. Use of the Website
5.1 We grant you a limited, non-exclusive, non-transferable and revocable permission to access the Website, and to view, download and print Content, for your personal, non-commercial and informational use, provided that you keep every copyright and other notice intact.
5.2 You may share a link to the Website, but you must not frame it, or present it in a manner that suggests that the Firm is connected with, or endorses, any person, product or service.
5.3 You are responsible for the equipment, software and internet access that you need in order to use the Website, and for any charges your service provider makes.
5.4 We may change, suspend or withdraw the Website, or any part of it, at any time, without notice and without liability to you.
5.5 You must use the Website only for lawful purposes and in accordance with these Terms and Applicable Law.
6. Prohibited Conduct
6.1 When you use the Website you must not:
(a) copy, reproduce, republish, modify, adapt, distribute, sell or exploit any Content for a commercial purpose without our prior written permission;
(b) use any robot, spider, scraper or other automated means to access the Website or to extract Content or data from it, except as search engines do in the ordinary way;
(c) attempt to gain unauthorised access to the Website, to our servers or to any system connected with them, or interfere with their operation, security or integrity;
(d) introduce any virus, malware, code or material that is harmful or disruptive, or that is intended to damage or interfere with the Website or with the equipment of any other person;
(e) overload the Website, or take any action that places an unreasonable burden on our infrastructure;
(f) send any Submission that is false, misleading, defamatory, obscene, abusive, threatening, harassing, discriminatory or otherwise unlawful, or that infringes the rights of any person;
(g) impersonate any person, or misrepresent your identity or your connection with any person or organisation;
(h) use the Website to solicit, advertise or promote any goods, services or professional work, or to send unsolicited communications to the Firm or to others;
(i) use the Content to suggest that the Firm endorses, or is associated with, you, your business or your cause;
(j) use the Website or the Content in a manner that would breach any law, including laws on privacy, data protection, confidentiality and intellectual property; or
(k) assist or permit any other person to do any of these things.
6.2 If you breach clause 6.1, we may, without notice, block or restrict your access to the Website, delete any Submission, report the matter to the authorities and take any other action that Applicable Law permits.
7. Intellectual Property Rights
7.1 The Website, the Content and all Intellectual Property Rights in them belong to the Firm or its licensors. These include the name Advocult India, its logos and its design, and the text, articles, graphics, layout and software of the Website.
7.2 Nothing in these Terms transfers any Intellectual Property Right to you. All rights that are not expressly granted to you are reserved.
7.3 You must not use the name, logo or any trade mark of the Firm, or any name or mark that is confusingly similar to them, without our prior written permission.
7.4 You may quote short extracts of the Content for the purposes of criticism, review, reporting or research, as the Copyright Act, 1957 permits, provided that you give clear credit to the Firm and to the source, and do not alter the extract or misrepresent it.
7.5 Third party names, logos and marks that appear on the Website belong to their owners. Their appearance does not mean that the owner endorses, or is associated with, the Firm.
7.6 If you believe that any Content on the Website infringes your rights, please send a written notice to the Grievance Officer at the details in section 17, identifying the material, the right you claim and your contact details. We will review it promptly and take whatever action we consider appropriate.
8. Enquiries, Submissions and Communications
8.1 You may contact the Firm through the contact details and forms on the Website. We will use any personal data in a Submission as the Privacy Policy sets out.
8.2 You are responsible for the accuracy and lawfulness of every Submission. You confirm that you have the right to send it, and that it does not breach the rights of any person or any duty of confidence that you owe.
8.3 We may, but are not obliged to, read, reply to or act on any Submission. We are not responsible for any Submission that is lost, delayed, corrupted or not delivered, and we do not promise any response within a stated time.
8.4 A Submission is not a request for legal advice that we are bound to answer, and sending it creates no duty on the Firm. Please see section 4.
8.5 Unless we have agreed otherwise in writing, a Submission is not treated as confidential or privileged before an engagement is in place. We will nevertheless handle it in line with our professional duties and the Privacy Policy, and we will not publish it.
8.6 You grant us a non-exclusive, royalty free licence to use, store and copy a Submission for the purposes of responding to it, running conflict checks, maintaining our records and protecting our legal position. Where a Submission contains personal data, this licence is subject to the Privacy Policy and Applicable Law.
8.7 We may communicate with you by email, telephone, message or letter at the details that you give us. Please tell us if those details change.
8.8 Ordinary email and messaging are not secure channels. If you need to send sensitive material, please ask us for a secure method first.
9. Careers, Internships and Applications
9.1 If you apply for a position, internship or training with the Firm through the Website or the contact details on it, you confirm that the information in your application is true, complete and not misleading, and that you may lawfully give it to us.
9.2 We will process the personal data in your application as the Privacy Policy sets out, for the purpose of assessing and handling your application and for the period stated in it.
9.3 Receipt of an application does not oblige the Firm to interview, employ or engage you. A vacancy or opportunity mentioned on the Website is not an offer, and no offer is made until it is given in writing and signed on behalf of the Firm.
9.4 The Firm does not charge any fee for an application, interview or selection, and it does not authorise any person to ask for money in connection with them. If any person asks you for payment in the name of the Firm, please tell us at once.
9.5 The Firm may decline to consider an application, or end the process at any stage, without giving reasons, to the extent that Applicable Law permits. We may verify the information in your application, including by contacting the references you give.
10. Third Party Links and Content
10.1 The Website may link to websites, documents and services that are owned or run by other persons, such as court and government portals, legal databases, publications, social media pages and maps. We do not control them, and we are not responsible for their availability, content, accuracy or privacy practices.
10.2 A link is given for your convenience. It does not mean that we endorse the third party, its content, its products or its services, or that we are associated with it.
10.3 Your use of any third party website is governed by that website’s own terms and privacy policy, and you use it at your own risk.
10.4 Where the Website carries a summary of, or a link to, a law, judgment, notification or other official document, the official text alone is authoritative. You should consult it before you rely on any summary.
10.5 You must not link to the Website from any site that is unlawful, defamatory, obscene or infringing, or in any manner that suggests our endorsement. We may require you to remove a link to the Website at any time.
11. Accuracy of Information and Disclaimer of Warranties
11.1 We take reasonable care to keep the Content accurate, but the law and the facts change, and we do not promise that the Content is complete, current or free from error. We have no duty to update it.
11.2 To the fullest extent that Applicable Law permits, the Website and the Content are provided on an “as is” and “as available” basis. We give no warranty of any kind, express or implied, including as to accuracy, completeness, fitness for a particular purpose, merchantability or non-infringement, or that the Website will be uninterrupted, timely, secure or free from viruses or other harmful components.
11.3 Any opinion expressed in an article, note or publication on the Website is the opinion of its author at the time of writing. It is not the opinion of the Firm on any particular matter, and it may differ from the law as it stands when you read it.
11.4 Nothing in this section excludes any warranty or liability that cannot be excluded under Applicable Law.
12. Limitation of Liability
12.1 To the fullest extent that Applicable Law permits, the Firm and its partners, advocates, employees, associates and agents are not liable to you for any loss or damage of any kind arising out of or in connection with your use of, or inability to use, the Website, or your reliance on any Content, whether in contract, in tort (including negligence), for breach of statutory duty or otherwise.
12.2 Without limiting clause 12.1, we are not liable for any indirect, incidental, special or consequential loss; for any loss of profit, revenue, business, goodwill, data or opportunity; or for any loss caused by a virus, a cyber attack, the failure of any network, server or equipment, or any delay or interruption in the Website.
12.3 Where Applicable Law does not permit liability to be excluded in full, our total liability for all claims arising out of your use of the Website is limited to the amount, if any, that you paid to us for access to the Website.
12.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law, including liability for fraud or wilful misconduct.
12.5 The limits in this section apply to the Website and to your use of it. They do not apply to services that the Firm provides under a written engagement, which are governed by the terms of that engagement, by the BCI Rules and by Applicable Law.
13. Indemnity
13.1 You agree to indemnify the Firm and its partners, advocates, employees, associates and agents, and to hold them harmless, against any claim, loss, liability, damage, cost and expense, including reasonable legal fees, that arises out of or in connection with:
(a) your breach of these Terms or of Applicable Law;
(b) any Submission that you make;
(c) your misuse of the Website or of the Content; or
(d) your infringement of the rights of any person.
13.2 We will tell you promptly of any claim for which we seek an indemnity. We keep the right to conduct the defence and settlement of the claim at your cost, in consultation with you.
13.3 This section does not apply to any claim to the extent that it arises from our fraud or wilful misconduct.
14. Privacy and Data Protection
14.1 We respect your privacy. The Privacy Policy explains what personal data we collect through the Website, why we collect it, how we use, share, store and protect it, for how long we keep it, how we use cookies, and what rights you have. It forms part of these Terms.
14.2 By using the Website you confirm that you have read the Privacy Policy. Where Applicable Law requires your consent for a specific use of your personal data, we will ask for it separately and clearly, and nothing in these Terms is that consent.
14.3 You may exercise your rights over your personal data, and may withdraw any consent you have given, by writing to the Grievance Officer at the details in section 17 and in the Privacy Policy.
14.4 If these Terms and the Privacy Policy conflict in relation to personal data, the Privacy Policy prevails.
15. Availability, Security and Suspension
15.1 We aim to keep the Website available, but we do not promise that it will be available at all times or free from faults. We may suspend or restrict access for maintenance, updates, security reasons or any other reason, with or without notice.
15.2 We take reasonable measures to protect the Website, but no website is completely secure. You are responsible for protecting your own devices and accounts, and for using up to date security software.
15.3 We are not responsible for any failure or delay in providing the Website that is caused by events beyond our reasonable control, including acts of God, flood, fire, epidemic, war, riot, strike, power failure, failure of telecommunications or internet services, cyber attack, or any order or action of a government or court.
15.4 If you notice a security weakness in the Website, please report it to us at the contact details in section 17. Please do not exploit it, or disclose it to others, before we have had a reasonable opportunity to address it.
16. Termination
16.1 We may, at any time and without notice, block, restrict or end your access to the Website if we believe that you have breached these Terms or Applicable Law, or for any other reason that seems to us sufficient.
16.2 You may stop using the Website at any time.
16.3 When your access ends, your permission to use the Website and the Content ends at once.
16.4 The sections of these Terms that by their nature are meant to continue, including those on intellectual property, disclaimers, limitation of liability, indemnity, and governing law and jurisdiction, remain in force after your access ends.
17. Notices and Grievance Redressal
